1. Introduction

Welcome to American Ironclad! These Terms of Service ("Terms") govern your use of our website and services. By accessing or using our website, or by contracting with us or purchasing our services, you agree to be bound by these Terms. If you disagree with any part of the Terms, then you may not access the website or use our services.  

2. Products and Services

American Ironclad offers the following products and services:

  • Encrypted Storage Devices (SecureDrives)

  • SecureTech Consulting

  • DataGuard Assurance

  • Secure Data Recovery & Destruction

3. Payment Methods

We accept the following payment methods for purchases on our website:

  • Credit cards: Visa, Mastercard, American Express, Discover

  • Debit cards: Most debit cards with a major card network logo (Visa, Mastercard, etc.)  

  • Mobile wallets: Apple Pay, Google Pay

  • Buy Now, Pay Later (BNPL): Afterpay

All payments are processed securely through Square, a leading payment processing platform. We comply with industry security standards (such as PCI DSS) to protect your payment information.

Additional details:

  • Currency: All payments must be made in US dollars.

  • Payment Timing: Your card will be charged immediately upon placing your order.

  • Payment Issues: If we encounter any issues processing your payment, we will notify you promptly and provide instructions on how to resolve the issue.

  • Refunds: Refunds will be credited back to the original payment method used for the purchase. Please refer to our Refund Policy for more details on processing times and eligibility.

4. Shipping

  • Shipping Methods: We utilize the shipping methods offered by our payment processing system, Square. This may include USPS, FedEx, UPS, or other carriers depending on the destination and package.

  • Shipping Costs: Shipping costs will be calculated either as a flat rate or based on the weight and destination of your order. The applicable shipping cost will be displayed at checkout before you complete your purchase.

  • Processing Time: Processing time depends on the nature of your order. Small storage devices (1TB or less) typically ship the next business day. Larger orders, such as those involving encrypted storage or custom configurations, may take longer. We strive to process all orders within a week and in a timely manner. If your order is expected to take longer than a week to process, we will contact you with an update.

  • Shipping Time: Estimated shipping times will be provided at checkout. Please note that these are estimates and actual delivery times may vary due to factors outside our control, such as weather or carrier delays.

  • International Shipping: We currently do not offer international shipping.

5. Returns and Refunds

  • Return Window: Returns are accepted within 30 days of the original purchase date. To be eligible for a return, you must contact us within 7 days of receiving your order.

  • Return Conditions: Products must be unused, unopened, and in their original packaging to be eligible for a return.

  • Refund Process: Refunds will be issued as store credit unless determined otherwise on a case-by-case basis. We reserve the right to review all circumstances and make a final decision on the refund method.

  • Restocking Fee: A restocking fee of 30% of the item's cost will be applied to all returns.

  • Non-Returnable Items: Services, custom software, and ISOs (at a later date) are non-returnable.

6. Disclaimers

  • Product Warranties: All products come with email support, 7 days a week, for the first year after purchase. This support covers general questions, troubleshooting, and guidance on repairs. Replacements may be subject to additional costs depending on the nature of the issue and the product's condition.

  • Service Agreements: All services provided by American Ironclad are offered "as is." We strive to provide excellent service and meet your needs, but we cannot guarantee specific outcomes or results. This includes data recovery services, where we cannot guarantee the successful recovery of all data. Similarly, for cybersecurity consulting services, we cannot guarantee that your systems will be impenetrable to all threats. We make no claims that imply absolute security or invulnerability.

  • Liability: While we take every precaution to protect your data and systems, we cannot be held liable for any damages or losses arising from the use of our products or services. Our liability is limited to the extent permitted by applicable law, including the Kansas Consumer Protection Act (K.S.A. 50-623 et seq.) and the Federal Trade Commission Act (15 U.S.C. § 41 et seq.).

  • Contracts for Services: For consulting and data recovery services, a separate contract will be sent to you along with the invoice. You must sign and return the contract before we commence any services.

  • Disclaimer of Guarantees: We make no guarantees or warranties, express or implied, about the effectiveness of our products or services beyond what's explicitly stated in these terms.

  • Indemnification: You agree to indemnify and hold American Ironclad harmless from any claims, losses, or damages arising from your use of our products or services.

  • Governing Law: These Terms of Service are governed by the laws of the State of Kansas.

  • Dispute Resolution: Any dispute arising out of or relating to these terms shall be settled by arbitration in accordance with the rules of the American Arbitration Association.  

7. Intellectual Property

All content on our website, including text, graphics, logos, images, and software, is the property of American Ironclad or its licensors and is protected by United States and international copyright laws.  

8. Changes to Terms

We reserve the right to modify these Terms at any time. Any changes will be effective immediately upon posting on our website. Your continued use of our website or services following the posting of revised Terms constitutes your acceptance of the changes.
